VIRUSES, HACKING AND OTHER OFFENCES

You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack.

By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. TERM

These membership terms will continue to apply at all times while you are a member or guest of our online club / make use of our site or any of the services. Some of the provisions remain in force after termination of your membership.

INFORMATION ABOUT YOU

As part of the application process you will be asked to provide personal information. You may also upload personal information to the public areas of the site. The policies and practices we adopt in processing your information and the principles which apply to the uploading and disclosing of certain of your personal information onto the public areas of the site are set out in our privacy policy. By using our site, you consent to such processing and disclosure of personal information and you warrant that all data provided by you is accurate.

MEMBERSHIP APPLICATION & ELIGIBILITY

Membership of the online club is by invitation only to individuals aged 18 or over and who are either:

  • Existing full members of The Hospital's London Club; or
  • Non-members of the Hospital but who are currently working in the creative industries in London; and

And all applicants must expressly accept our website use terms, these membership terms, the acceptable use policy and the privacy policy.

Please note that all applications to join the online club have to be approved by our membership committee before the application is approved and an invitation to join our online club does not guarantee that the membership committee will approve your application for membership, we therefore reserve the right to reject all applications for membership at our sole discretion.

By using our site and by registering as a member or guest of our online club you warrant to us that you are over 18 and that you have the right, authority and capacity to agree to and to abide by these membership terms and the website use terms.

MEMBERSHIP LEVELS

These are:

1. Basic

  • Free of Charge (at present time though we reserve the right to introduce a fee)
  • 10 Profile views per day
  • 3 messages per day
  • 10MB storage limits
  • No right to apply to job posts
  • No right to place listings in services directory
  • No access to Hospital online events
  • We may at our discretion make certain content available to Basic members but there is not guarantee that we will do so.
  • 2. Premium

    Fee: �10 per month or one-off annual payment of �60.00 (at the present time, we reserve the right to increase the fees in future).

    • Full access to our site and the interactive services
    • 100MB storage limit
    • Right to post jobs in accordance with our terms for job postings, subject to any terms relating to job postings which we may publish jobs from time to time.
    • Right to post listings in the services directory, subject to any terms relating to services postings which we may publish from time to time.

    3. The Hospital

    Full access and privileges (as for Premium) are included free of charge in the Hospital Membership subject to agreement of these membership terms, the website use terms, the acceptable use policy and the privacy policy. We reserve the right to introduce fee for use of the online service by members of the Hospital club in future.

    SUBSCRIPTIONS

    If you sign up for multiple subscriptions to the online club, you will be limited to only one instances of the online club messenger service, regardless of the number of subscribing accounts you may have with us.

    TRANSFER

    You are not permitted to sell, transfer or attempt to transfer your membership or guest access to our online club nor are you permitted to allow any third party to make use of your access privileges via your internet connection.

    We may transfer or assign our rights in the site, the online club and / or any of the services we provide through the site at any time and without restriction.

    OUR LIABILITY

    To the extent permitted by law, we, other members of our group of companies, employees, directors and third parties connected to us hereby expressly exclude:

    • All conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity.
    • Any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with your membership of the online club, our site or our services or in connection with the use, inability to use, or results of the use of our site or our services, any websites linked to it and any materials posted on it, including, without limitation any liability for:
      • loss of income or revenue;
      • loss of business;
      • loss of profits or contracts;
      • loss of anticipated savings;
      • loss of data;
      • loss of goodwill;
      • wasted management or office time; and
    • for any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.

    This does not affect our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, nor any other liability which cannot be excluded or limited under applicable law.

    The provisions of this section will remain in force after termination.

    INDEMNITY

    You agree to indemnify and hold us harmless from any losses or costs (including reasonable legal fees) we incur arising from your use of our site and / or our interactive services, any breach by you of these term, the membership terms or the acceptable use policy or any breach of any representations or warranties made in those documents or that you have given during the application process.

    The provisions of this section will remain in force after termination.

    USER DISPUTES

    This site and the services provided on it enable you to socialise and interact with other members and guests of our club and, as permitted by these terms, our membership terms and our acceptable use policy, to promote your services to other members or guests or to identify services or opportunities which may be of interest to you. However, if you become involved in any dispute with another member, guest or other third party as a result of your interaction with other members, guests or third parties through this site, you agree to resolve this directly with the person(s) with whom you are in dispute. We reserve the right to involve ourselves in such disputes but are under no obligation to do so.

    The provisions of this section will remain in force after termination.

    TERMINATION

    Termination of Membership : Basic

    You may terminate your membership of our online club at any time, by contacting a member of The Hospital online team who will delete your account on behalf of The Hospital Group Ltd.

    We may terminate your membership and / or restrict your access to the site or some or all of the services provided by us, effective upon sending notice of termination to you.

    Termination of Membership : Premium

    You may terminate your membership of our online club, for any reason by contacting a member of The Hospital online team who will delete your account on behalf of The Hospital Group Ltd.

    Where you are paying your membership fee by monthly payment, termination of your subscription will take effect at the end of the next calendar month after the month in which we receive your notice. Where you are paying by single annual payment termination of your subscription will take effect at the end of the annual period for which you have paid. We regret that we are unable to offer any refunds or rebates of membership fee if you decide to terminate your subscription early.

    Where you pay your membership fee by monthly instalments, we may terminate your membership and / or restrict your access to the site or some or all of the services provided by us by giving you one month's notice of termination.

    Where you pay your membership fee by a single annual payment, we may terminate your membership and / or restrict access to the site or some or all of the services provided by us by notice to you at or prior to the end of any annual period for which you have paid, or at our option, sooner by making a pro-rata refund of your annual membership fee.

    Termination of Membership : Member of The Hospital's London Club

    You may terminate your membership of our online club, for any reason by contacting a member of The Hospital online team who will delete your account on behalf of The Hospital Group Ltd.

    Your membership of the online club will automatically cease when your membership of The Hospital's London club expires without renewal or where it is terminated by you or by us, for any reason whatsoever.

    Termination : Other Circumstances

    We may terminate your membership and / or restrict your access to the site or some or all of the services provided by us without prior notice to you in the following circumstances:

    (a) where we consider (in our sole discretion) that you are abusing the site, the services or other members or guests of the club or where you are otherwise acting in breach of the these website use terms, these membership terms, the acceptable use policy or any of the documents referred to in any of those documents;
    (b) where there is a regulatory or statutory change limiting the ability to provide access to the site or the services;
    (c) where there is an event beyond our reasonable control preventing us from providing access to the site or the services; or
    (d) where we determine that it is no longer economically viable for us to continue to provide the site or the services.

    If we terminate your membership in any of the circumstances described in the above paragraph you will not be entitled to any refund of unused subscription fees.

    If we terminate your membership of our online club in the circumstances described in paragraph (a) above we reserve the right at our sole discretion to terminate your membership of The Hospital's London club.

    Even after membership is terminated, certain provisions of these membership terms, the website use terms, the acceptable use terms and the privacy policy will all remain in effect.

    GENERAL

    Any failure or delay by us in enforcing compliance with these membership terms or the terms of any other document referred to in these membership terms shall not be a waiver of that or any other provision of these membership terms, the website use terms or acceptable use policy.

    If any provisions of these membership terms or any of the documents referred to in these membership terms is unlawful, void or for any reason unenforceable then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining terms or the terms of any documents referred to in these membership terms.

    A person who is not a party to the agreement entered into between us relating to your membership of our online club has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any of these membership terms, the website terms or the acceptable use policy but this does not affect any right or remedy of a third party specified in those documents or which exists or is available apart from that Act.

    The headings in these membership terms are for reference purposes only and do not limit the scope of extent of the membership terms.

    The provisions of this section will remain in force after termination.

    ENTIRE AGREEMENT

    These membership terms and all documents referring to in these membership terms constitute the entire agreement between us and you as to your use of the site, and your membership and use of our club and the services we provide to members and guests.

    JURISDICTION AND APPLICABLE LAW

    The English courts will have non-exclusive jurisdiction over any claim arising from, or related to, a visit to our site although we retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country. These membership terms and all documents referred to in these membership terms are governed by English law.

This acceptable use policy sets out the terms between you and us under which you may access our website www.thehospital.co.uk (our site) and, where you are a member or guest of our online club (online club), use the services which are available via our site. Prohibited uses

You may use our site only for lawful purposes and as permitted by our policies from time to time. You may not use our site:

  • In any way that breaches any applicable local, national or international law or regulation.
  • In any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect.
  • For the purpose of harming or attempting to harm minors in any way.
  • To send, knowingly receive, upload, download, use or re-use any material which does not comply with our content standards (see below).
  • To transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam).

Our site enables members to view each other's Profiles and to share other personal information via the interactive services. You agree that you will only use other members' personal information published on the site in accordance with the applicable laws and regulations (including, without limitation, data protection laws) and, without limitation to the other provisions of this acceptable use policy, our website terms and our membership terms, that you will only use other members' personal information for lawful purposes relating to our online club or such other purposes that the other member concerned expressly permits.

Content standards

These content standards apply to any and all material which you contribute to our site (contributions), and to any interactive services associated with it.

You must comply with the spirit of the following standards as well as the letter. The standards apply to each part of any contribution as well as to its whole.

Contributions must:

  • Be accurate (where they state facts).
  • Be genuinely held (where they state opinions).
  • Comply with applicable law in the UK and in any country from which they are posted.

Contributions must not:

Suspension and termination

We will determine, in our discretion, whether there has been a breach of this acceptable use policy through your use of our site. When a breach of this policy has occurred, we may take such action as we deem appropriate.

Failure to comply with this acceptable use policy constitutes a material breach of the terms of use and a material breach of the online club membership terms upon which you are permitted to use our site and access our services, and may result in our taking all or any of the following actions:

  • Immediate, temporary or permanent withdrawal of your right to use our site or some or all of the services available through our site.
  • Immediate, temporary or permanent removal of any posting or material uploaded by you to our site.
  • Issue of a warning to you.
  • Immediate, temporary or permanent termination of your membership of our online club as well as your membership of The Hospital Group Ltd (where applicable).
  • Legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach.
  • Further legal action against you.
  • Disclosure of such information to law enforcement authorities and, where appropriate in connection with a claim for breach of copyright, to the lawyers acting on behalf of the owner of the materials concerned as we reasonably feel is necessary.

We exclude liability for actions taken in response to breaches of this acceptable use policy. The responses described in this policy are not limited, and we may take any other action we reasonably deem appropriate.
